In the event that this contract may not be performed by Cordua Catering or client due to force jameure, includeing, but not limited to, acts of God, acts of terror, acts of war or other acts of enemies, government regulations, disasters, strikes, civil disorder, curtailment of transportation facilities or other emergency beyond the control of Cordua Catering or client, thus making it inadvisable, unsafe, or impossible to carry out the event which is the subject of this contract for catering services, then Cordua Catering shall be entitled to retain fifty percent (50%) of the total amount of any deposits then required to be paid by Client to Cordua Catering under the terms of this contract as full and final payment under this contract, and Cordua Catering shall have no current of future obligation of any kind under this contract or otherwise. Thereafter, Cordua Catering shall refund the balance, if any, of such deposits to Client. In the event that Client has not previously tendered to Cordua Catering any required deposit, Client shall immediately, upon requred by Cordua Catering pay to it the amount required by this paragraph. Client recognizes and agrees that the exact amount of damages to Cordua Catering on account of any force majeure cannot be accurately ascertained and that the amounts provided for herein are not to be construed in any sense of penalty.
